Welcome to NaturallyColored.com (hereinafter "Naturally Colored" or The "Website"), we thank you for choosing our website. These Terms of Use agreement (hereinafter The "Terms") sets forth the terms and conditions governing your use of the Website and your access to and use of the information, content and services offered on the Website (which, collectively constitute the "Services").

Furthermore, your privacy is important to us. Our Privacy Notice is available on our homepage and at every point where personally identifiable information may be requested. Naturally Colored is committed to protect the privacy of its users. The Privacy Policy explains what information we collect, how we store it and how we use it. We take great care in safeguarding your personal information and in complying with all applicable federal and state privacy laws and our own internal standards and best practices.

By accessing, using or completing any transactions on our Website or any of our Services, you declare that you have read our Privacy Notice and that you understand, accept and agree to the content included on the Privacy Notice, such as, but not limited to, methods of information collection and its use.

Notwithstanding the above said, you accept and agree to be legally bound by these Terms, and agree to all operating rules and/or policies of Naturally Colored and the Services that may be offered by Naturally Colored on the Website. All these rules and policies are incorporated into these Terms by reference.

If you do not agree, do not enter or use the Website.

The Website serves as a market place for diamonds and designed jewelry. We reserve the right to change the appearance of the Websie, the contents which appear therein, the special offers and benefits that have been advertised thereon, or any other necessary change, with or without notice and in our sole discretion, as well as to update or otherwise modify these Terms from time to time. You are responsible for checking these Terms periodically for changes and updates. Your use of the Website and any related service following posted change(s) and update(s) will be deemed an acceptance of such change(s) and update(s).

OUR PRODUCTS

Products being presented and/or sold on the website may belong to Peled Diamonds LTD, its affiliates and/or partners. Each of the products is unique. There are no two identical diamonds for sale on our website. Most of the diamonds that are sold through our website are authenticated and provided to you with a certificate of authenticity issued by such Gemological Institute. Copies of the certificates of authenticity can be viewed on our website next to each diamond that is displayed for sale. At times, Naturally Colored may sell several diamonds together, either as a piece or jewelry or loose. In such case, it is possible that some of the diamonds (if any) will have a certificate and some won't. It is our prime concern to offer our customers the best service possible to ensure a complete customer satisfaction.

DESIGNED JEWLRY

Naturally Colored offers you a one of a kind and unique opportunity to select a designed jewelry to accompany your purchased diamond(s) (hereinafter The "Designed Jewelry").

Thus, we present you with unique set of designers who offer their exclusive designs and contribute their recommendations regarding the Designed Jewelry that match the diamond(s).

Each jeweler whom we chose to participate and present his designs on our Website has a private section on the Website (hereinafter The "Designer Private Section"). In the Designer Private Section you can find additional information about the jeweler and a gallery of his/her designs.

Furthermore, to complete and enhance your shopping experience, beside each diamond(s), on the item specific page, you will find one or more recommended Designed Jewelry that can accompany and match the specific diamond(s).

When purchasing, you will be able to choose whether to receive the diamond(s) already embedded in the Designed Jewelry (hereinafter The "Mounted Jewelry ") or instead, to receive the specification and simulation file(s) in order to be able to have a designer of your choice making the Mounted Jewelry.

For the removal of any doubt, Naturally Colored does not design any jewelry, the Designed Jewelry is made by independent jewelers who wish to display and sell their products on the Website and Naturally Colored offers the designers an adequate and unique platform to do so. Each designer receives a full payment for each of his/her purchased Designed Product. Naturally Colored shall not be held liable for any dispute that may arise due to any of the designer(s) action(s) with regard to any of the Designed Jewelry, including but not limited to Intellectual Property disputes, quality assurance disputes and shipments and deliveries disputes.

PROCESS AND DELIVERY OF ORDERS

  1. Territory

    Naturally Colored delivers its diamonds worldwide (including: US, Hong Kong, Canada, Australia, England, China and most of Europe). It should be noted that each delivery shall be subject to the destination country's regulation (for example, there are countries that do not allow the entrance of diamonds which exceed a certain value)

    Naturally Colored delivers its Mounted Jewelry to locations that are only within the United States. Please check the possibility of any shipment to your country, before placing an order.

  2. Insurance

    All shipped orders are insured by us until the product has been delivered to the customer.

  3. Payment methods

    Payment for the products can be made on the Internet. Our online clearing service is provided by PayPal. Before making the shipment, each order is verified manually by the staff and may acquire email confirmation manually.

    1. Internet. All internet orders are made by the customer by filling out the e-form provided on the Website. Please be sure to provide the exact billing address and telephone number. Incorrect information may cause a delay in processing your order. Please note that we only ship if there is a correlation between billing and shipping address. If not, we may request to verify your address and you will be requested to fax a copy of your ID and credit card to us. When an order is placed, we will remove the item from our website to avoid multiple purchases.
    2. Fax and Telephone. All orders will be collected by telephone or by receipt of the order form printable from our website.
    3. Order confirmation. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order nor does it constitute confirmation of our acceptance to sell a product. We reserve the right, at any time after receipt of your order but prior to shipment, to accept or decline your order for any or no reason. We may need to verify any information you provide before we accept an order. Item availability and prices for all products sold by Naturally Colored are subject to change without notice. You should be aware that orders will not be processed until you receive specific confirmation that the order has been accepted.
    4. Third party financing. We will not be liable or responsible for any third party financing ability (such as Bill Me Later, Get Financing) – not for its financing conditions and not for its approval to finance.

We reserve the right to cancel any approved order, prior to its delivery, in case there is any error with the order (from any reason). In case we will choose, at our sole discretion, to cancel the order, you will receive any delivered payment in the same fashion it was paid.

SHIPPING

  1. METHOD OF DELIVERY

    All orders are delivered by diamond courier specialists (such as, but not limited to, Malca Amit, Brinks etc.) subjected to their delivery regions and insurance company's approval. Deliveries will not be made to Post Office Boxes.

  2. SHIPPING EXPENSES

    Each delivery is complementary and its cost shall be borne by us. The customer may be required to pay an additional cost according to the customs regulations in his individual country (US and Hong Kong exempt).

  3. PROCESSING TIME

    You can expect your order to be processed immediately within approval of payment (approximately 48-72 hours if using money transfer), provided that there are no problems with payment verification. Naturally Colored does not guarantee same day-shipping. Orders are not processed on weekends and public holidays.

    The shipment itself takes between 2-4 working days for delivery within the US, between 3-6 working days for delivery to Canada and to most European countries, and between 10-21 working days for delivery to China.

    On rare occasions, delivery may be delayed up to 10 days, due to exhibitions etc., in any case of urgency it is recommended to pre-check the processing time before placing an order.

    Furthermore, some countries demand the filling of needed forms. Delaying in filing the needed forms may cause a delay in delivery. We will not be responsible for any such delay.

  4. RETURN POLICIES

    Any return of products, must be coordinated with us prior to its return. Failure in doing so and the costs which may be derived from such failure will be borne by the costumer.

    All diamond purchases can be returned after their delivery within 14 days from the date you receive the product, provided the returnable purchases are attached with the gemological certificate and all the related and received accessories.

    In the event that a customer returns a diamond, all associated costs including return shipping, insurance and any other cost will be borne by the customer. Naturally Colored shall not be held responsible for any returned item that is not actually received or that is not returned in accordance with these Terms. In such an event, the customer will also reimburse Naturally Colored for all associated shipping costs borne, or not borne, by Naturally Colored for the shipping.

    Diamonds and/or Jewelry that have been fitted, inlayed, placed, worn or modified in any way, are not returnable.

    If a diamond and/or a Jewelry piece shall be returned to us, and if we think it is necessary, we reserve the right to re-send the diamond to the Gemological Institute for verification (at our own cost), we will only refund the purchase price once the diamond and/or Jewelry has been inspected, checked, authenticated and evaluated by a neutral and well known gemological institute. For this end, you must return the product along with the gemological certificate that was attached to it when it was delivered to you and all of its related and delivered accessories. Failure to do so will result in a refusal to accept the returned diamond and/or the Jewelry piece. This review process can take some time and Naturally Colored makes no guarantee or representation as to how long this process may take. Naturally Colored will only refund the customer when it is satisfied, at its sole discretion, that the returned diamond and/or Jewelry is in the exact condition as it was originally shipped to the customer.

    Premium Return Delivery
    United stated residents, who have purchased diamonds worth more than 5,000$ are entitled to a free premium return delivery. We will collect the diamonds from your home address and insure its delivery on our expense. United stated residents, who have purchased diamonds worth less than 5,000$, may receive the Premium Return Delivery by bearing the cost of 80$.

AVAILABILITY

We will never purposely charge a customer for an item that we do not physically have in stock at the time of purchase. In such instance, we will refund your payment for the item, along with any applicable tax fees and shipping charges.

BLOOD DIAMONDS

All Naturally Colored diamonds are purchased from legitimate sources which are not involved in funding a conflict and in compliance with UN regulations. Our suppliers have guaranteed that the diamonds sold to us are conflict free, based on personal knowledge and/or written guarantees provided by the supplier of the diamonds.

COLOR RENDITION

We have used our reasonable efforts to display as accurately as possible the colors of the products shown on the Website. However, because the colors you actually see depend on your computer's monitor, we cannot guarantee that your monitor’s display of any color will be accurate. Furthermore, unless specified otherwise, the graphic images of our products are the actual images of the products. The images do not represent the size or quality of the product. Differences in the size of an image do not represent differences between any of our products.

ERRORS, INACCURACIES AND OMISSIONS

The information on this Website may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). All images are for illustration purposes. Please note that such errors, inaccuracies or omissions may relate to the product description, product image, pricing and availability. We apologize for any inconvenience this may cause you. In the event a product is listed at an incorrect price due to an error, Naturally Colored reserves the right to refuse or to cancel any order placed for products listed at the incorrect price. Naturally Colored shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Naturally Colored shall issue a credit refund to your credit card account in the amount of the incorrect price and the product order will be cancelled.

TITLE AND RISK OF LOSS

Naturally Colored will advise the customer of estimated shipping dates, but Naturally Colored will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

JURISDICTION; GOVERNING LAW

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Naturally Colored and Customer shall be governed by the laws of the State of Israel and the sole jurisdiction is granted to the courts in Tel-Aviv.

ENTIRE AGREEMENT

These terms and conditions, together with Naturally Colored invoice regarding the products ordered by customer, are the complete and exclusive agreement between Naturally Colored and the customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Naturally Colored and the customer, relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

COPYRIGHT AND TRADEMARKS

All content included on this site, such as, but not limited to, images, text, graphics, logos, and button icons, is the property of Naturally Colored or its content suppliers and is protected by United States and international copyright laws. All content on the Website that is not the property of Naturally Colored is used with permission. The arrangement and compilation of all content on this Website are the exclusive property of Naturally Colored and are protected by U.S. and international copyright laws.

The Trademarks of Naturally Colored may not be used in connection with any third-party products or services or in any manner that disparages or discredits Naturally Colored.

PRODUCT DESCRIPTIONS

Naturally Colored attempts to describe the products offered on the site as accurately as possible. However, Naturally Colored does not warrant that products descriptions or other content of the Website are accurate, complete, reliable, current, or error-free.
